The studies we went through in this work focused their attention on the impact of a judicial system on several economic variables, such as credit access, firm size, competitiveness, investments and firm birth rate. These researches share a common and unanimous outcome: having a better judicial system, faster, with reduced costs and limited number of procedures, is not just a matter of justice itself or of fairness and certainty of law. Such a rigorous judicial system plays a pivotal role on economic growth. It affects, positively or negatively, the competitiveness of an entire economic system. Thus, a wider number of countries are monitoring the trends of their judicial system and are taking appropriate measures to tackle issues such as gigantic backlog and pathological pending trials. Italy, that comes from a not enviable number of pending cases close to 5,7 millions in 2009, has taken a remarkable step forward reducing to 3,7 millions the number of unsolved trials. Our country reached this target through a mix of measures: governative reforms, organisational changes and adoption/diffusion of best practices and Case Management Softwares. Much has been done, but still a lot needs to be done, especially to reduce the pathological backlog and stop the hemorrhage of public financial resources we are granting as equitable relief. Some potentially useful initiatives, highly recommended by european and international institutions, might be considered to face and resolve at the root the problem:
• Hire new personnel, above all administrative staff to assist the judges (the current vacancy is around ten thousand people)
• Invest in ICT and computer literacy
• Encourage ADR (Alternative Dispute Resolution) and the use of the simplified and shortened proceeding
• Promote Court Specialisation
• Empower Chief Administrative Officers with minor jurisdictional functions
• Limit the oncoming cases to the Second Instance through a more effective reasonableness filter
